EURASIAN COUNTRIES – CONFORMITY FOR TR CU CERTIFICATION EAC MARK

Knowledge of the technical requirements for an accurate risk analysis is essential in order to create products that comply with the regulations in effect in the target markets. This particularly applies to machinery manufacturers and industrial plants that wish to export their products to member countries of the Eurasian Customs Union: Russia, Belarus and Kazakhstan, and since 2016 Armenia and Kyrgyzstan; these manufacturers must first achieve compliance with obligatory regulatory standards before affixing the EAC mark (EurAsian Certification), which is no easy task.

The goal of the Eurasian Economic Union is to create a group of Member States united by an economic foreign policy that requires the uniformity of prices, and tariffs and circulation rules that are increasingly harmonized with international standards.

In fact, since 2012, 34 Technical Regulations of the Customs Union (TR CU) have been promulgated for different types of products (e.g. TR CU 010: 2011 on the safety of machinery and equipment; TR CU 012: 2011 on the safety of the equipment for operation in explosive atmospheres), whose fulfilment leads to the EAC mark on the products themselves.

Each technical regulation went into effect between 2012 and 2015 and the classification of products for certification purposes only takes place through the combined nomenclature (customs code).

Since a foreign entity (manufacturer and/or supplier) can no longer be the holder of the certificate or the declaration of conformity, the figure of the agent has emerged. Such an agent acts on behalf of the foreign manufacturer in matters relating to the conformity of products placed on the Customs Union market, assuming any and all responsibility deriving from the products’ non-compliance with the requirements of the applicable regulations.
