Obligations

The quality of the water we use every day is a fundamental element for our health. With the entry into force of the Legislative Decree of 23 February 2023, implementing Directive (EU) 2020/2184, important new provisions have been introduced to ensure greater safety and control in the management of drinking water.

Among these is the recognition of the Managing agent as the Internal Water Distribution Manager (GIDI), the figure responsible for the wholesomeness and cleanliness of the water up to the point of use: the tap.

This new legislation strengthens the principle of public health protection, assigning greater responsibility to the managers of internal systems, both in condominium systems and in public and private facilities.

Steps Required

The GIDI (Internal Water Distribution Manager() is responsible for maintaining water systems in conditions of efficiency and safety, ensuring that the water distributed remains compliant with the quality parameters established by the Decree. In particular, the GIDI must:

• carry out periodic inspections of water networks and systems;

• perform drinking water quality inspections, identifying any critical issues (scale deposits, obsolete tanks, ageing pipework);

• verify that materials in contact with water are suitable and free from health risks;

• monitor the presence of chemical and microbiological contaminants, including lead, Legionella and PFAS.

The legislation introduces new limits and reference parameters, extending control to emerging substances such as Bisphenol A, haloacetic acids and uranium, and including risk management for lead and Legionella.

Regulatory Framework

The Employer is required to ensure that patients are provided with equipment that complies with safety requirements, as established by the legislation in force.

Such equipment must be:

• suitable for health and safety;

• appropriate and adaptable to the work carried out;

• subject to regular maintenance in order to maintain safety standards over time (Art. 71, paragraph 1, Italian Legislative Decree 81/2008).

Medical Devices Regulation (EU) 2017/745 (MDR)

In force since 26 May 2020, the MDR replaced the previous Directives:

• 93/42/EEC (medical devices);

• 90/385/EEC (active implantable medical devices).

Regulatory Framework: equipment must be tested and maintained in accordance with CEI EN 62353 (CEI 62-148).
